1. Formation of the Travel Contract

1.1 By booking a trip, the traveller offers TREKZ Travel Solutions GmbH (“TREKZ”) the conclusion of a package travel contract on the basis of the published offer and these Terms and Conditions.

1.2 The contract becomes binding once the booking confirmation (travel confirmation) has been received by the traveller.

1.3 Bookings can only be made by persons of legal age. The lead traveller is responsible for all participants listed in the booking if this has been expressly agreed.



2. Payment Terms and Insolvency Protection

2.1 Upon receipt of the booking confirmation and the legally required insolvency protection certificate (“Sicherungsschein”) pursuant to § 651r BGB, an advance payment of 40 % of the total travel price is due.

2.2 This higher deposit is justified because TREKZ must, from the time of booking confirmation, make binding and non-refundable pre-payments to partners (such as creator fees, event or sport tickets, DMC and hotel services) that represent a significant portion of the total travel cost.

2.3 The balance payment is due 45 days before the start of the trip, provided the insolvency certificate has been issued and the trip will take place as planned.

2.4 For bookings made within 45 days prior to departure, the full travel price becomes immediately payable upon confirmation, provided the insolvency certificate has been issued.

2.5 If payment is not received in full despite reminder and reasonable grace period, TREKZ reserves the right to cancel the contract and charge cancellation fees in accordance with Clause 5.



3. Scope of Services

3.1 The scope of services results from the respective travel description, additional information and the booking confirmation.

3.2 TREKZ reserves the right to make necessary, reasonable changes to individual travel services that do not materially alter the overall nature of the trip.

3.3 Special requests and side agreements require written confirmation by TREKZ.



4. Price Adjustments

4.1 TREKZ may increase the travel price after contract conclusion if transportation costs, taxes, fees or exchange rates have significantly changed (§ 651f BGB).

4.2 Any increase is limited to 8 % of the total price and may only occur up to 20 days before departure.

4.3 If the increase exceeds 8 %, the traveller may withdraw from the contract free of charge.



5. Cancellation by the Traveller

5.1 The traveller may withdraw from the contract at any time prior to departure. The date of receipt of the written cancellation notice by TREKZ shall be decisive.

5.2 As compensation, TREKZ may charge an appropriate cancellation fee based on the time of withdrawal and the total travel price.

5.3 Since all TREKZ Experiences are special packages with non-refundable components (e.g. creator services, event or sports tickets, hotel and DMC arrangements), 100 % of the travel price is payable upon cancellation from the time of booking.

5.4 This special condition is clearly communicated before booking.

5.5 The traveller may prove that TREKZ incurred no loss or a significantly lower loss.

5.6 TREKZ strongly recommends taking out a travel cancellation insurance and, if applicable, medical repatriation coverage.



6. Cancellation or Termination by TREKZ

6.1 TREKZ may cancel the trip if the minimum number of participants specified in the offer is not reached. In this case, notice must be given no later than 20 days prior to departure.

6.2 TREKZ may terminate the contract without notice if the traveller persistently disrupts the trip despite prior warning or behaves contrary to the contract. In this case TREKZ retains the right to the full travel price minus any saved expenses.



7. Liability and Warranty

7.1 TREKZ is liable for the proper performance of the agreed travel services with the due care of a prudent merchant.

7.2 Liability for damages other than personal injury is limited to three times the total travel price, unless the damage was caused intentionally or by gross negligence.

7.3 TREKZ is not liable for third-party services that are clearly identified as such (e.g. optional local events).

7.4 Travellers must promptly notify TREKZ of any deficiencies so that remedial action can be taken. Failure to do so may limit claims.



8. Limitation Period

All contractual claims arising from non-conforming travel services expire two years after the contractual end of the trip in accordance with § 651j BGB. The limitation period begins on the day on which the trip was scheduled to end.



9. Entry, Health and Visa Regulations

9.1 TREKZ provides general information on applicable passport, visa and health requirements for the destination country to the best of its knowledge.

9.2 Travellers are responsible for complying with these regulations and for obtaining necessary documents in due time.

9.3 Any additional costs resulting from non-compliance shall be borne by the traveller.



10. Data Protection

TREKZ processes personal data exclusively for the purpose of fulfilling the travel contract and in accordance with the EU General Data Protection Regulation (GDPR). Personal data will only be transferred to partners involved in operating the trip.



11. Final Provisions

11.1 The invalidity of individual provisions shall not affect the validity of the remaining provisions.

11.2 The contractual relationship is governed by German law (§§ 651a ff. BGB) in accordance with EU Directive 2015/2302.

11.3 For lawsuits by travellers, the place of jurisdiction is their place of residence; for lawsuits by TREKZ, the traveller’s residence or, if the traveller is a merchant or legal entity under public law, the seat of TREKZ (Germany) shall apply.

11.4 TREKZ does not participate in dispute-resolution procedures before a consumer arbitration board.
